Underage Drinking and Driving in New Jersey
In New Jersey, you must be 21 to purchase possess or consume
alcoholic beverage. Any person under the legal
age to purchase alcoholic beverages who knowingly possesses without
legal authority or who knowingly consumes any alcoholic beverage in any
school, public conveyance, public place, or place of public assembly,
or motor vehicle, is guilty of a disorderly persons offense, and shall
be fined not less than $500.00. This does not apply to persons
possessing alcohol due to employment. If this offense
occurs in a motor vehicle, or if you bought the alcohol, you will lose
your license for 6 months. If you do not have your drivers
license, the suspension starts when you are first eligible to receive a
license. You may also have to participate in an alcohol education
program. If you drive during this suspension period, in
addition to penalties for driving with a suspended license, there are
enhanced penalties for being on the suspended list for this
situation. If you are under 21 and drive with any detectable
amount of alcohol in your system (.01 BAC or above), you will be
subjected to the following penalties:
- Loss or postponement of driving privileges for 30 to 90
days
- 15 to 30 days of community service
- participation in a program of alcohol education and highway
safety
You can also be prosecuted for DWI, even if your
blood or breath alcohol level is less than 0.08%.
